Understanding New Jersey’s Medical and Recreational Cannabis Laws

Now, we’ve expanded our store to include adult-use cannabis. However, before you dive into the world of cannabis, it’s crucial to understand some rules and regulations. This knowledge is vital to enjoy your cannabis responsibly. In this blog, we’ll cover the basics of New Jersey’s medical and recreational/adult-use laws to get you in the know.

New Jersey’s Medical Cannabis Laws

New Jersey’s Medicinal Cannabis Program (MCP), formerly known as the Medicinal Marijuana Program, plays a vital role. The program ensures that registered patients receive safe and convenient access to cannabis-based medicine. These patients must be under the care of licensed healthcare practitioners. The MCP provides this access through our regulated and closely monitored facilities.

  • As part of your medicinal treatment, your doctor or healthcare practitioner can provide you with cannabis orders, allowing you to obtain up to 84 grams of cannabis every 30 days. You can fill these orders at any state-licensed Alternative Treatment Centers (ATCs) or dispensaries throughout New Jersey.
  • Some patients may have difficulty traveling to a dispensary, so you can designate and register caregivers who can make purchases on your behalf.
  • Patients and caregivers must always have their proper identification, including their MCP cards, with them. 
  • You should store medicinal cannabis in its original labeled packaging. We strongly encourage patients to use medicinal cannabis only in the comfort of their own homes and to transport it only when absolutely necessary.
  • Never share your dose with anyone else, as medicinal cannabis is intended solely for the registered patient’s consumption. It’s also essential to remember not to smoke on federal lands or in federal buildings. Smoking in a moving private vehicle is not allowed either.
  • Currently, the law does not permit home cultivation of cannabis. Patients and caregivers are not allowed to grow cannabis or have cannabis plants. Also, it’s crucial not to operate any form of transportation or heavy equipment while under the influence of medicinal cannabis, as this could be dangerous.
  • Lastly, never attempt to transport medicinal cannabis across state lines. If you have unwanted medicinal cannabis, you can return it to an ATC (Alternative Treatment Center) for proper disposal. When doing so, make sure to present your valid registry identification card, a New Jersey driver’s license, or another state-issued photo ID. Your safety and compliance with these guidelines are of utmost importance.

New Jersey’s Recreational/Adult-Use Cannabis Laws

In New Jersey, anyone who’s 21 years or older, whether you’re a resident or just visiting, can buy cannabis. You can find it at licensed cannabis dispensaries across the state. 

  • When you make a purchase, dispensaries can sell up to 1 ounce (28.35 grams) of usable cannabis. This may include dried flower, concentrates, vaporized products, or ingestible cannabis-infused items like gummies.Pre-roll joints in a cannabis dispensary
  • Keep in mind that the product availability may vary from one dispensary to another, and some items like cookies and brownies are not available. 
  • Prices will differ based on location and product, with New Jersey sales tax and a social equity excise fee of 1/3 of 1% added to each transaction.
  • When you visit a dispensary, you’ll need to show a government-issued ID to prove you’re 21 or older, but they won’t make copies or keep records of your purchase beyond what’s necessary for the financial transaction. 
  • As for where you can use your cannabis, it’s allowed in private spaces, but be aware that landlords may have rules against it on their property. 
  • Importantly, it’s illegal to transport cannabis across state lines, so you can’t take it out of New Jersey. However, you can gift up to 1 ounce of cannabis to another adult who’s 21 or older, as long as you don’t accept any payment or compensation for it.

Lastly, driving while high is illegal, and the same laws regarding driving under the influence apply to cannabis. So, please stay safe and responsible when using cannabis.
